According to Celebuzz, the trial may be delayed until 2013. The trial was originally set for October 1, but the prosecutor on the case says the chances of it going on that day are slim. Joe Giudice, if you recall, chose to stand trial on charges he obtained a phony driver’s license rather than accept a plea bargain that would have sent him to prison for 5 years.

Giudice, 42, accompanied by his attorney, Miles Feinstein, rejected the state’s plea offer of five years in state prison during a brief appearance in Superior Court in Paterson. He, instead, will stand trial on charges that he used his brother Pietro’s identity in an attempt to obtain a driver’s license at the Motor Vehicle Commission office in Paterson in June 2010.
“We will prepare for a trial,” Feinstein told Judge Greta Gooden Brown. The judge set a date of Oct. 1 for both sides to return to court to set the trial date.
Authorities allege that Giudice obtained a driver’s license using marriage and birth certificates that belong to his brother. At the time, Giuseppe Giudice’s license had been suspended for Driving While Intoxicated after he flipped his pickup while driving in Montville in January 2010.
Prosecutors began to investigate the brothers when Pietro, 39,(another brainiac) was pulled over by Lincoln Park Police. When the police officer ran Pietro’s information through a dashboard computer, the search produced Giuseppe’s photograph, authorities said.
Obtaining a false driver’s license is considered a serious offense in the post 9/11 world. In New Jersey, obtaining a false driver’s license is punishable by up to 10 years in prison.
Chief Assistant Prosecutor Jay McCann said the state has offered Giudice a flat, five-year sentence in state prison. Feinstein argues that because Giudice has no prior criminal convictions, he should be eligible for probation.
Teresa did not attend the court hearing, Feinstein thought her appearance would create a “media circus”.
